Are Builders and Renovators Essential Workers in Times of Pandemic?

When the COVID situation first started affecting us back in March/April, we were working on providing temporary buildings for the Health Service on various sites in Southern England. The work was ramped up as it was thought the buildings would be needed quicker than initially anticipated. We were working long days, seven days a week.

Due to the urgency of the situation, we received paperwork designating us as essential workers. This paperwork was required to show to the police if we were stopped on the roads. On one occasion, we were required to travel from one site to another where our skills were urgently needed. A large assembly could not proceed until the issue was resolved. There was a bad crash on the motorway, and the road was closed, preventing our movement. We were called back and instructed what to do. We were given a police escort to navigate through the blockage and reach the construction site.

While I did not consider myself or my men to be 'essential workers,' some people did. This highlights the subjectivity of the term and the importance of understanding the government's definitions.

Defining Essential Workers

Modern governments have their own definition of essential workers based on what they deems it to be. However, through the ages, it is known that there are three essentials of life: food, clothing, and shelter. In the context of the current pandemic, it is crucial to understand these basics and how they relate to government measures.

Understanding Definitions

First, realize that there are various forms of shelter recognized by governments, such as homeless shelters and churches. Secondly, there is a difference between constructing for oneself and doing it as a career. Additionally, based on the governing body, during a lockdown, the definition of essential construction activities can vary. Some aspects of construction and remodeling are more essential than others.

Individual Rights vs. Government Orders

If you are a millionaire without a house and you are in the middle of building a home using workers, builders, contractors, etc., you have a fundamental right to complete the building to provide shelter. You should be able to use those funds to finish building your house instead of being forced to live in hotels. However, this is not legal advice, and one might need to argue such a case in court if they are subjected to a specific society and its governing body.

Discretion in Classifying Essential Work

In the professional capacity, the discretion to classify what is considered essential and non-essential lies with the government. During a lockdown, governments determine which aspects of construction and remodeling are deemed essential. This decision can vary based on the geographic location and the specific measures in place.

Understanding the nuances and definitions of 'essential workers' can be pivotal in navigating the challenges presented by pandemics and other emergencies.
