When a lease ends, it does not automatically give birth to a new lease. Each lease is unique, even if the words and amounts are the same as prior leases. This means that landlords are under no legal or moral obligation to stay in sync with any previous leases when requesting a new tenant to sign a lease for the next 12 months.

Therefore, you can change virtually any aspect of the lease, including the rent, as long as proper notification is given.

However, landlords can change the terms of the lease at any time, as long as they follow the notification method and period stated in the lease. Most leases require 30 days' notice, but 60, 90, or even different periods might be specified depending on the local law or landlord preference.

For example, at the end of your lease, you can inform the tenant of upcoming rent changes with the same notice period used in the initial lease. This gives tenants the option to move out or accept the new terms. A proper renewal form with the changes clearly listed would be beneficial. An example might look like this:

The expiration date of the lease agreement between above named Tenant and Owner for the property located at the above-named Address is hereby extended to DATE.

Rent shall be RENT per month effective DATE. The holding over amount will be RENT.

All terms and conditions agreed to in the prior lease between the parties dated DATE and any other changes to or additional terms and conditions as noted below are incorporated into and hereby made a part of the lease renewal. Both parties agree that no other additional agreements or conditions, verbal or otherwise, unless specifically stated below, are made a part of the lease terms.

Additional Terms and Conditions:

New late fees will be 5% of the monthly rent amount.

Tenant will be responsible for lawn care.

Each party acknowledges receipt of a copy of this extension agreement.
